BypassNow - Terms and Conditions (Customer)

Welcome to BypassNow (the “App”), operated by BypassNow ("we", "us", or "our"). These Terms and Conditions ("Terms") explain how you can use our App and services. By downloading, registering, or using our App, you agree to follow these Terms. If you do not agree, please do not use the App.

1. What We Do

We connect you with professional Drivers who can drive your car for you. Drivers are independent professionals — not our employees. We provide the technology platform to make bookings easy.

2. Booking a Driver

• You can book a Driver for a trip or for a specific time through the App.
• Once a Driver is assigned, you will receive their name, contact number, and ID details.
• The Driver will operate your vehicle according to your instructions and applicable traffic laws.
• You must ensure your vehicle is roadworthy and has valid documents (RC, insurance, PUC, etc.).

3. Payment

• The fare for each trip is shown in the App before booking.
• Payment is made digitally through the App and payments are processed through third-party payment providers;
• Drivers are paid after the trip is completed; we handle the payment process on your behalf.
• Refunds are not provided after a trip unless there is a verified issue or error.

4. Cancellation and No-Show

• You can cancel a booking before the trip starts. Cancellation charges may apply as shown in the App.
• If you fail to appear at the pickup point within 15 minutes of the scheduled time, or cancellation done after 10 minutes of the driver being allocated then the booking may be marked as "no-show" and charges may apply.

5. Customer Responsibilities

• Treat the Driver with respect and provide a safe environment.
• Do not ask the Driver to drive illegally, under unsafe conditions, or while intoxicated.
• Do not share or lend the booked Driver to someone else.
• Report any incident, complaint or issue through the App or customer support promptly.

6. No-Poaching / Direct Hiring Policy

• You agree not to directly hire, offer employment to, or engage the Driver assigned to you outside the App during or after your booking.
• All bookings must be made only through the App. Any attempt to bypass the App or directly hire a Driver may result in account suspension or termination.
• A penalty fee of ₹10,000 (INR Ten Thousand) may be charged for violations, or such other reasonable amount determined by the Company.

7. Our Role and Limitation of Liability

• We are a technology platform that connects Customers and Drivers. Drivers provide services independently.
• We are not responsible for accidents, theft, damage, delays, or losses that occur during a trip.
• We are not liable for Driver misconduct or negligence. Our total liability for any claim shall be limited to the service fee charged for the relevant trip.

8. Insurance and Damages

• You must maintain valid motor insurance for your vehicle covering personal and third-party risks.
• Any accident, damage or insurance claim arising during the trip shall be addressed under your insurance policy and applicable law.
• The Company is not responsible for processing or paying insurance claims.

9. Privacy and Data Use

10. Account Suspension or Termination

We may suspend or block your access to the App if you misuse the service, violate these Terms, commit fraud, or attempt to directly hire Drivers outside the App.

11. Indemnity

You agree to indemnify and hold harmless the Company, its officers and agents from any claim, loss, damage, or costs (including legal fees) arising out of your use of the App or your vehicle during a trip.

12. Force Majeure

We are not liable for delay or failure to perform caused by events beyond our reasonable control, including natural disasters, strikes, government actions, or internet outages.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of India. Any dispute will be subject to the exclusive jurisdiction of the courts in Bangalore.

14. Changes to Terms

We may update these Terms from time to time. We will notify you through the App or by email. Continued use of the App after updates means you accept the revised Terms.
